Man will face trial after judge rejects plea agreement

KINGWOOD — A Bruceton Mills man will face trial after a plea agreement was not accepted by the judge.

At an earlier hearing, Preston Circuit Judge Steven Shaffer deferred ruling on accepting the plea agreement for Donald Carl Stout, 70. On Thursday, Shaffer did not accept the plea deal. The case now goes to trial.

In March 2019, Stout was indicted on charges of first-degree sexual assault, sexual abuse and two counts of child abuse resulting in injury. He was already a convicted sex offender.

If Shaffer had accepted the plea agreement, Stout would have been sentenced to 10-20 years. The proposed agreement called for him to serve his sentence on home confinement. Stout would have been ordered not to have contact with children and would receive credit for time served.

Shaffer deferred ruling on the agreement until a sex offender risk and evaluation plan was done.

He set the trial for May 26.
