Trial set for man who rejected plea bargain

KINGWOOD — A trial was scheduled for Randy Emmit Stone after he rejected a plea bargain Monday in Preston Circuit Court.

Stone, 38, of Tunnelton, was indicted by the March grand jury for possession of a controlled substance (meth) with intent to deliver.

At the plea hearing, Stone’s attorney, Sam Hess, told the court his client changed his mind about accepting the plea offered by the prosecution.

Hess said he wanted to enter a motion to suppress some evidence in the case instead.

Assistant Prosecutor Megan Allender said a hearing on the motion to suppress would take two hours.

“I don’t have the lab results back,” on the evidence, Allender said. “They were filed [with the lab] but are not back yet.”

According to the criminal complaint, police found two bottles of suspected meth weighing about 6 grams, a gram bag and another bottle of suspected meth and a small blue bag with a substance that tested positive for meth, when they arrested Stone.

Stone said he was out of work and sometimes trades the meth for goods, according to the complaint.

Preston Circuit Judge Steve Shaffer set a pre-trial hearing for Dec. 10 and trial for Dec. 17.
