Woman injured in frat fall sues Sigma Chi in Monongalia County court

MORGANTOWN — A woman who said she slipped and fell on a wet dance floor, causing her to lose a tooth and sustain other injuries, is suing the fraternity where it happened.
The suit, filed by Olivia Younis in Monongalia County Circuit Court on Sept. 14, names Sigma Chi Fraternity, Sigma Chi Corp., Sigma Chi Fraternity Mu Mu Chapter and Sigma Chi House Corp.
Mu Mu is the WVU chapter of Sigma Chi.
According to the suit, Younis attended a party at the Sigma Chi house, 700 North High St., on
Sept. 16, 2016. The then-20-year-old plaintiff was not on any guest list submitted to WVU prior to the event.
Younis was provided alcohol, including liquor at the event, which impaired her judgment and ability to perceive hazards, according to the suit.
The suit called the dance floor at the party “unreasonably dangerous” and said it was dimly lit, recently waxed and covered with alcohol and other liquids.
Younis slipped and fell on the dance floor, landing on her face, which caused facial fractures, a lost front tooth and cuts. She needed surgery to re-implant the tooth, the suit claimed.
The suit claimed the defendants knew the area was not reasonably safe and they did not take reasonable steps to improve the condition.
Sigma Chi also failed to follow relevant laws, rules, regulations and guidelines — specifically those governing the service of alcohol to underage guests.
The suit said the conduct by Sigma Chi was so reprehensible that punitive damages should be given to punish the defendant and deter similar situations.
It also asks for compensatory damages.
