Preston man settles civil suit against Wal-Mart out of court

KINGWOOD — A civil case against Wal-Mart filed by a local man has been resolved out of court.
Jonathan David Mann filed suit in 2017 in Preston County Circuit Court against Wal-Mart Stores Inc. He said there was nothing to notify customers that the floors were wet, that he fell and had ongoing medical costs.
Wal-Mart Stores filed an answer in the case, saying that its actions did not cause the accident or any injuries to Mann.
A final order in the case was filed recently. It says that attorneys for both sides had come, “to inform the Court that the parties have settled all claims, issues and disputes in the above-captioned civil action.”
The suit is dismissed with prejudice, meaning it cannot be filed again.
“It is the intention of the parties to dismiss with prejudice all claims which have been raised, or could be raised,” according to the order signed by Senior Status Judge Lawrance Miller Jr.
No details of any settlement are included in the court file.
Mann’s attorney, Edmund Rollo, had no comment Friday on the suit. Wal-Mart was represented by Bowles Rice LLP, which did not return a call requesting comment in time for this report.
