According to the Preston County criminal complaint, the officer was dispatched to the Stone Avenue home of Rogers’ daughter, Stephanie Rogers, after James Rogers arrived at the scene to "obtain his firearms." The firearms were previously removed from James' possession at the recommendation of the Veterans Affairs Hospital due to mention of self-harm and early onset dementia.

James Rogers arrived at Stephanie's home unannounced, grabbed Stephanie by the neck, shoved her backwards and "raised a hammer as if he was going to strike her," the complaint said.

Stephanie Rogers confirmed the allegations with the reporting officer using her home's security cameras.

James Rogers fled in a maroon pickup truck before the reporting officer arrived and was arrested at a traffic stop on East State Avenue, Terra Alta.
