Preliminary hearing rescheduled in alleged sexual assault

MORGANTOWN — A preliminary hearing for an alleged second-degree sexual assault charge has been continued after the defendant was unable to secure a lawyer.

According to the criminal complaint, Austin Rempel, 31, of Morgantown, allegedly “forcibly shoved his hand up” a victim’s dress and touched her inappropriately against her will July 30, 2016. Just prior to this incident, the victim stated Rempel took a photo of himself with her phone and put it in her phone with his contact information. This photo, dated July 30, 2016, was provided to detectives.

Rempel’s petition for a court-appointed attorney for the initial preliminary hearing was denied, which led to the rescheduling of this hearing.
