Woman sues construction company over electrical shock

A Fairmont woman claims she was floating in a pool when a construction company working nearby struck an underground line, causing her to be shocked.

As a result of her injuries the plaintiff, Daleen R. Berry, has endured pain and suffering and will continue to in the future, has lost wages, and suffered an impairment to her ability to enjoy life and earn a living, the suit says.

According to the suit, Berry was floating in a swimming pool on Brettwood Lane, which is near Greystone Drive, on July 16, 2019, when the defendant, Anderson Excavating, LLC, “damaged, cut, and/or disrupted an underground power line with excavating equipment while working in proximity to the property.”

The Dominion Post could not reach Anderson Excavating for comment on Wednesday. According to its website, the company offers construction services including site development, trucking, soil modification, and environmental services.

The suit claims Anderson failed to properly identify or mark the electrical line before digging, failed to take the right safeguards to prevent the line from being damaged while digging, follow established guidelines, rules, regulations, and laws applicable to excavating near high-voltage lines and more.

As a result of Anderson’s negligence, Berry suffered an electrical shock, the suit states.

It seeks compensatory damages “in an amount deemed fair, just, and equitable by the court.”
