Woman sues man who struck her in crosswalk

MORGANTOWN — A Maryland woman is suing a Morgantown man who struck her with his vehicle while she was in a crosswalk.

The suit was filed on behalf of Tesia Jones Wednesday in Monongalia County Circuit Court. She is represented by attorneys Timothy Manchin and Taylor Downs. Michael Williams is named as the defendant.

Jones was walking in a crosswalk on University Avenue about 6 p.m. on March 6, 2019. Around that time, Williams who was driving his 2015 Ford Mustang north on University Avenue crossed a double yellow line to improperly pass the vehicle in front of him and hit Jones while she was in the crosswalk, according to the suit.

Williams was cited for improper passing and failure to yield, according to the suit. As a licensed driver, he had a responsibility to keep a proper lookout for pedestrians, exercise care and operate his vehicle in a safe manner. As a result of Williams’ negligence, Jones suffered serious bodily injury.

Jones suffered a “crushing injury of the right foot,” right knee pain and anxiety, as a result of the crash, the suit states. Those injuries have required her to undergo medical treatment and will require more treatment in the future. So far, Jones has accrued $18,546.18 in medical expenses which will go up with future treatments, the suit says.

The crash also caused Jones to be “sore and lame” right after the crash and continuing into present day, according to the suit. She has suffered mental and psychical pain and been unable to go about her daily life.

The suit seeks a “fair and equitable” amount of money to compensate Jones for her injuries, pre-and-post-judgment interest, and attorneys’ fees.
