CHARLESTON — The State Senate passed SB 360, the bill to nullify the state Supreme Court’s Leggett ruling on gas well royalty deductions, 34-0 on Feb. 28 and sent it to the House.

The Leggett v. EQT case allows deductions of post-production expenses from royalties on old flat-rate leases converted to 1/8 leases via 1982 legislation.

SB 360 forbids those deductions. Sen. Charles Clements, R-Wetzel, called it a win-win for the state and for property owners, who will be paid on the full value of their minerals.
