Special prosecutor request denied in High St. murder case

MORGANTOWN — Judge Russell Clawges denied the request for a special prosecutor at a Monday motion hearing.

The defense for Lemir Baker-Moore, Fran Whiteman, asked Clawges to appoint a special prosecutor because of a potential conflict of interest. Whiteman said the prosecutor’s office hired a private investigator that the defense has used.

Baker-Moore was charged with first-degree murder in the shooting death of Brian Green near the Dollar General on High Street.

Clawges said he did not think the situation required a special prosecutor so long as an appropriate separation was built and denied the motion.

Whiteman’s motion to get the criminal history of the witnesses was approved.

The trial is set for next week.
